 Three Liberty Township Planning Commissioners Subpoenaed

The three Liberty Township Planning Commissioners who voted to recommend denial of the proposed planned residential development (PRD) known as Liberty Valley submitted by the Wormald Companies of Frederick Maryland were subpoenaed to the public hearings being held on the proposal. 

The stated purpose of the subpoenas is "to present testimony regarding the review of the Liberty Valley Tentative Plan by the Liberty Township Planning Commission".  The Commissioners subpoenaed include Phil Burgess, Chair of the Commission, and Bart Hogan and Peter Foscato, members.  

The subpoenas were issued for Monday, January 19, 2004 at 6:30 PM.  The members were not called at that time but were informed they would be called Wednesday, January 21, 2004 at 6:30 PM.
 
Additionally, Bill Packer, one of the Co-Chairs of the Save Our Liberty Citizens Association, received a subpoena to produce lists of names of Save Our Liberty members, Board members and donor lists, or provide the persons who maintain the lists. 

This was subpoena was issued for Monday, January 19, 2004.  Mr.. Packer, under advice of counsel did not provide lists or people.  There was legal discussion between the developer's attorney (Charles Zwally) and the Save Our Liberty attorney (Susan Smith) where Mr. Zwally said he would seek court action on Tuesday, January 20, 2004.

The hearings resume Wednesday, January 21, 2004 at the Fairfield Fire Hall.
